§1 Scope and Provider

These Terms and Conditions apply to all orders placed through the online shop NICA FLORA – Owner: Nikol Milanova.

According to §19 of the German VAT Act (UStG – Small Business Regulation), VAT is not charged.

Our Terms apply exclusively. Conflicting or differing terms from the customer are not accepted unless explicitly agreed upon in writing.

§2 Conclusion of Contract

The presentation of products in this online shop does not constitute a legally binding offer, but an invitation to place an order.
By clicking the button “Buy Now”, the customer submits a binding offer to conclude a purchase contract.

The contract is concluded when we confirm the order by e-mail or dispatch the goods.

§3 Prices and Payment

All prices are final prices in euros (€).
Under §19 UStG, no VAT is charged (small business regulation).

Payment methods available:

  • PayPal

  • Credit / Debit Card

  • Bank Transfer

Payment is due immediately upon conclusion of the contract.

§4 Shipping and Delivery

Delivery is made to the address provided by the customer.
Shipping provider: DHL (or an equivalent service provider)

Estimated delivery times:

  • Within Germany: approx. 3–5 business days

  • Within the European Union: approx. 5–9 business days

If an item is unavailable at the time of order, the customer will be informed promptly.
Payments already made will be refunded in full.

Shipping costs are displayed during the checkout process.

§5 Right of Withdrawal

Consumers have the right to withdraw from this contract within 14 days without giving any reason.
Details can be found in our Return & Refund Policy.

No right of withdrawal exists for products made to the customer’s individual specifications or personalized items in accordance with §312g (2) No.1 BGB.

§6 Retention of Title

Goods remain the property of NICA FLORA – Nikol Milanova until full payment is received.

§7 Warranty

Statutory warranty rights apply (§§ 434 et seq. BGB).
The warranty period is two years from delivery.

Because our products are made from real preserved flowers and handcrafted materials, slight variations in color, shape, or size are natural and do not constitute defects.

§8 Liability

We are liable without limitation for damages resulting from intent or gross negligence, as well as for injury to life, body, or health.
For slight negligence, liability only applies in cases of breach of essential contractual obligations, and is limited to the foreseeable, typical damage.

§9 Product Description and Variations

All our creations are handmade using real preserved flowers.
Minor variations in color, form, or texture may occur due to the natural materials used and do not constitute grounds for complaint or return.

§10 Safety Notice

Our products are not edible.
Please keep them out of reach of children and pets.
We are not liable for damage caused by improper use.

§11 Custom Orders

Many of our items are custom-made according to the customer’s wishes.
For such orders, the right of withdrawal does not apply (§312g Abs. 2 Nr. 1 BGB).
Returns or exchanges are only possible in cases of proven defect or damage.

§12 Final Provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
If any provision of these Terms is invalid, the remaining provisions remain valid.
